Terms and Conditions

Welcome to Ninto (“Ninto,” “we,” “us,” or “our”), a platform operated by Byepo Technologies Pvt Ltd (“Company”). These Terms and Conditions (“Terms”) govern access to and use of the Ninto platform, including its website and mobile application (together, the “Platform”), during its Closed Beta phase. By creating an account or otherwise accessing the Platform, you agree to be bound by these Terms.
1. Definitions and Parties
1.1“Health Professional” or “HP” means an individual who registers on the Platform to create a professional presence, share content, and participate in professional communities related to their field of health practice.
1.2“Careseeker” means an individual who registers on the Platform to access health-related content, participate in condition-based communities, and connect with Health Professionals.
1.3“User,” “you,” or “your” refers to any HP or Careseeker who accesses or uses the Platform.
1.4“Content” means any post, comment, embed, profile information, or other material submitted to or displayed on the Platform.
1.5These Terms apply only to HPs and Careseekers. No other user role, account type, or organizational account currently exists on the Platform.
2. Closed Beta Status
2.1The Platform is currently offered as a closed beta (“Beta”). Features, functionality, and availability may be added, modified, restricted, or withdrawn at any time without prior notice.
2.2Ninto does not guarantee any specific level of uptime, availability, or performance during the Beta period, and the Platform is provided on an “as available” basis.
2.3Ninto may, at its discretion, end the Beta, transition to general availability, or discontinue the Platform. Where reasonably possible, Ninto will provide notice of material changes affecting existing Users.
2.4Participation in the Beta does not entitle a User to continued access, and Ninto reserves the right to modify or terminate any User’s account during this phase, subject to Section 9.
3. Nature of the Platform
3.1Ninto is a technology platform that enables Health Professionals and Careseekers to connect, share information, and participate in community discussions relating to health topics.
3.2Ninto does not provide medical services, medical advice, diagnosis, or treatment, and does not employ or supervise any Health Professional in a clinical capacity.
3.3No use of the Platform creates a doctor-patient relationship, a therapist-client relationship, or any other clinical relationship between a Careseeker and an HP, unless and until such a relationship is separately and explicitly established outside the Platform.
3.4Ninto does not endorse, recommend, or guarantee the qualifications, conduct, or advice of any HP appearing on the Platform, beyond what is expressly stated in Section 4.
4. Verification and Moderation
4.1Verification Status. HPs may hold one of two verification states: “Pending” or “Verified.”
(a)Pending. An HP account defaults to Pending status upon registration.
(b)Verified. An HP account is marked Verified only after completing: (i) Stage A registration via mobile number and OTP; (ii) Stage B submission, comprising a lookup against the National Medical Commission (or equivalent professional council) registry through a third-party verification provider, and identity confirmation via Aadhaar retrieved through DigiLocker with the HP’s explicit consent; and (iii) manual review of the compiled results by Ninto’s review team.
(c)A Verified badge indicates that the stated professional registration and identity information were checked against the referenced sources at the time of verification. It does not constitute a warranty, guarantee, or endorsement of the HP’s current standing, competence, or the accuracy of any other profile content, and it does not certify the quality of any advice, content, or service the HP provides.
(d)A Pending status does not imply any wrongdoing; it means Stage B has not yet been completed or approved.
4.2Moderation Status. Independently of verification, every account holds a moderation status of “Active” or “Blocked.”
(a)Blocked status results only from a violation of these Terms, applicable law, or Ninto’s content and conduct guidelines, including as a result of a user report or Ninto’s own review.
(b)Blocked status is never applied solely because an HP has not completed or passed verification; a Pending HP remains Active unless independently blocked under this Section 4.2.
4.3Ninto reserves the right to request re-verification at reasonable intervals, including periodic re-checks against applicable regulatory blacklists.
5. Eligibility and Registration
5.1To register, a User must provide a valid mobile number and complete OTP-based confirmation.
5.2HPs may register regardless of whether they are listed in the Health Professional Registry (“HPR”) at the time of signup. HPR-listed and non-HPR HPs are both eligible for Pending status upon signup and Verified status upon completing Stage B.
5.3There is no manual or alternative path to Verified status other than successful completion of Stage B as described in Section 4.1(b). Ninto does not offer expedited or discretionary verification outside this process.
5.4Users must provide accurate information during registration and keep such information current. Providing false information, including false professional credentials, may result in Blocked status and, where applicable, removal from the Platform.
6. User Conduct
6.1General. All Users agree not to: (a) impersonate any person or entity; (b) post unlawful, defamatory, or harassing content; (c) share another person’s confidential health information without consent; (d) misuse the Platform to solicit, advertise, or transact outside its intended purpose; or (e) attempt to circumvent the verification or moderation systems described in Section 4.
6.2Health Professionals. HPs must represent their qualifications accurately and must not present unverified claims as verified, nor use the Platform to make claims exceeding their actual scope of practice or registration.
6.3Careseekers. Careseekers must engage respectfully within community spaces and must not use the Platform to solicit or provide clinical advice outside their own personal experience-sharing.
7. Content and Intellectual Property
7.1User Content. Users retain ownership of Content they post. By posting Content, a User grants Ninto a non-exclusive, worldwide, royalty-free license to host, display, and distribute that Content within the Platform, including across relevant community sections, the User’s profile, and the Platform’s home feed, for as long as the Content remains posted.
7.2Embedded Content. The Platform may display publicly available third-party content through standard embedding methods (such as oEmbed, iframe embeds, or RSS feeds). Such embeds carry whatever attribution the source platform’s own embed format natively provides (for example, a platform logo and creator handle, where supported). Ninto does not independently add, alter, or remove attribution on embedded content.
7.3No Endorsement. The appearance of embedded content on the Platform does not imply any partnership with, or endorsement by, the source platform or the original creator, nor does it imply Ninto’s endorsement of the embedded content’s accuracy.
7.4Removal Requests. A rights-holder who believes their content has been embedded, displayed, or otherwise used on the Platform without appropriate authorization may request its removal by writing to contact@ninto.in. Ninto will review such requests and remove or disable access to the relevant content where warranted.
8. Health Information Disclaimer
8.1Content on the Platform, whether posted by a User or displayed via embed, is provided for general informational and community-discussion purposes only. It is not medical advice and should not be treated as a substitute for professional consultation.
8.2The Platform is not intended for use in a medical emergency. If you are experiencing a medical emergency, contact your local emergency services immediately.
9. Termination and Suspension
9.1Ninto may suspend or terminate a User’s access where that User’s account is Blocked under Section 4.2, or where continued access would violate applicable law.
9.2A User may deactivate their own account at any time. Verification status under Section 4.1 is not affected by voluntary deactivation, and reactivation may require re-verification depending on elapsed time and applicable Platform policy at the time.
9.3Sections 3, 7, 8, 10, and 11 survive termination of a User’s access.
10. Limitation of Liability
10.1The Platform is provided “as is” and “as available” during the Beta period, without warranties of any kind, express or implied, including as to accuracy, completeness, or fitness for a particular purpose.
10.2To the maximum extent permitted by applicable law, Ninto shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform, including reliance on any Content, embedded or user-posted, or on any HP’s Verified status.
10.3Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.
11. Governing Law and Grievance Redressal
11.1These Terms are governed by the laws of India. Courts at [City], India shall have exclusive jurisdiction over any dispute arising from these Terms, subject to applicable law.
11.2In accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, Ninto provides an email contact@ninto.in to address user concerns and grievances.
Ninto will acknowledge grievances and work to resolve them within the timelines prescribed under applicable law.
12. Modifications
12.1Ninto may update these Terms from time to time, particularly as the Platform moves through and beyond the Beta phase. Material changes will be notified through the Platform or via the registered mobile number. Continued use after such notice constitutes acceptance of the updated Terms.
